Acceptable Use Policy

This Acceptable Use Policy (the "AUP") sets out the rules for using the Bellafy platform, website, and services operated by Bellafy LLC ("Bellafy", "we", "us", or "our"). It applies to Merchants, End Users, partners, and anyone who accesses the Service. Violating this AUP may result in suspension or termination of access, as described in our Terms of Service.
1. General Rules
You agree not to use the Service in any way that:
(a) violates any applicable law, regulation, or third-party right;
(b) is fraudulent, deceptive, or misleading;
(c) infringes intellectual property rights, including copyrights, trademarks, or trade secrets;
(d) harms, threatens, harasses, or discriminates against any person or group;
(e) interferes with, disrupts, or compromises the integrity or security of the Service or related systems;
(f) attempts to gain unauthorized access to any account, system, or data;
(g) uses the Service to transmit malware, spyware, ransomware, or any malicious code; or
(h) resells, sublicenses, or otherwise commercializes the Service without our prior written consent.
2. Prohibited Merchant Content and Services
As a Merchant, you are solely responsible for the services, products, prices, descriptions, and media you publish through Bellafy. You may not use the Service to offer, sell, promote, or facilitate:
(a) services or products that you are not legally authorized, licensed, or qualified to provide;
(b) prescription-only or regulated medical treatments without the required licenses, prescriptions, or qualified supervision (including, without limitation, botulinum toxin, dermal fillers, prescription-only pharmaceuticals, and other treatments restricted by law);
(c) services that involve counterfeit, unapproved, or illegally imported cosmetic or medical products;
(d) adult or sexual services, escort services, or services marketed with explicit sexual content;
(e) services targeted at minors in a way that is inappropriate or unlawful;
(f) misleading health, beauty, or weight-loss claims that cannot be substantiated;
(g) services offered in violation of consumer protection, labor, tax, health, or safety laws;
(h) services or content that promote hate, violence, harassment, or discrimination against any protected class; and
(i) any other activity restricted by Stripe or by payment card network rules.
3. Rules for End Users of the PWA
As an End User of a Merchant's PWA, you agree not to:
(a) provide false, inaccurate, or impersonated identity or contact information;
(b) make bookings in bad faith, such as repeated no-shows or fraudulent cancellations designed to disrupt the Merchant;
(c) misuse loyalty points, vouchers, referrals, or promotional codes, including through duplicate accounts or artificial referrals;
(d) initiate chargebacks without first attempting to resolve the issue with the Merchant;
(e) submit content (such as reviews, messages, or profile data) that is abusive, defamatory, threatening, discriminatory, obscene, or that infringes the rights of others; or
(f) attempt to disrupt or gain unauthorized access to any Merchant's account or data.
4. Security and Integrity
You may not: (a) probe, scan, or test the vulnerability of the Service without our prior written permission; (b) circumvent, disable, or otherwise interfere with any security-related features of the Service; (c) access the Service through automated means (bots, scrapers, crawlers) except through APIs we explicitly provide; (d) impose an unreasonable load on our infrastructure; or (e) decompile, reverse engineer, or disassemble the Service or attempt to extract source code, except to the extent expressly permitted by law.
If you discover a security vulnerability, please report it responsibly to security@bellafy.app. We welcome good-faith security research and will not pursue legal action against researchers who follow responsible disclosure practices.
5. Communications and Anti-Spam
If you use the Service to send emails, SMS, push notifications, or other communications to End Users:
(a) you must comply with all applicable anti-spam laws, including the CAN-SPAM Act, TCPA, and any state-level equivalents;
(b) you must have a lawful basis to contact the recipient and must honor opt-out requests promptly;
(c) you may not send unsolicited commercial communications to individuals who have not consented or with whom you do not have a prior business relationship;
(d) every marketing message must clearly identify the sender and include a functioning unsubscribe mechanism;
(e) you may not use harvested, purchased, or scraped contact lists.
Bellafy may suspend the use of communication features for accounts with high complaint, bounce, or spam-trap rates.
6. Rules for Partners
If you participate in Bellafy's partner program, you agree not to:
(a) refer yourself or use synthetic, fake, or duplicate accounts to generate commissions;
(b) bid on Bellafy brand keywords in paid search (including "Bellafy", "bellafy.app", and common misspellings) without our prior written consent;
(c) register or use domain names that are confusingly similar to Bellafy's;
(d) make misleading, false, or unsubstantiated claims about Bellafy's features, pricing, or performance;
(e) impersonate Bellafy or present yourself as an employee, agent, or official representative;
(f) use cookie stuffing, forced clicks, iframes, or any other method of artificially inflating referrals;
(g) engage in spam, unsolicited email marketing, or unauthorized use of trademarks in advertising.
Violations may result in forfeiture of pending and future commissions and termination of the partner account, in addition to any remedies available under the Partner Agreement.
7. Data Handling
You may not use the Service to collect, store, or process personal information in violation of applicable privacy laws. In particular, you must not:
(a) use End User data for purposes not disclosed to the End User;
(b) export or share End User data with third parties without a lawful basis;
(c) process special categories of personal data (such as detailed health data) beyond what is strictly necessary for the services you provide.
Merchants remain the data controllers of End User data they collect through the Service, as described in our Terms of Service and Privacy Policy.
8. Artificial Intelligence and Automated Content
If you use artificial intelligence or automated tools to generate content (such as service descriptions, reviews, or images) displayed on the PWA, you must:
(a) ensure the content is accurate and not misleading;
(b) not present AI-generated reviews or testimonials as authentic;
(c) comply with applicable laws regarding AI disclosures.
Fake reviews or testimonials are strictly prohibited and may result in immediate account termination.
9. Enforcement
We investigate suspected violations of this AUP. Depending on the severity and nature of the violation, we may: (a) issue a warning; (b) remove or restrict access to specific content or features; (c) suspend the account temporarily; (d) terminate the account; (e) withhold or reverse partner commissions; or (f) report the conduct to law enforcement or other authorities.
We may act immediately and without prior notice when we believe the violation poses a risk to the Service, to users, or to third parties, or when required by law.
Account termination for AUP violations does not entitle you to any refund of fees already paid.
10. Reporting a Violation
If you believe someone is violating this AUP, please report it at abuse@bellafy.app with as much detail as possible. We review all reports but may not be able to respond individually to every submission.
11. Changes to this Policy
We may update this AUP from time to time. When we make material changes, we will notify you by email or through the Service at least 15 days before the changes take effect.
